Participation

Article 1: definitions

These terms and conditions are understood by:

  1. Event: the event that is organized by Free 2 Play Marketing.
  2. Participant: the person who has signed up for the event in a manner permitted by the Organizer to participate in the Event.
  3. Agreement: the agreement that is mandatory to participate in the Event.
  4. Organizer: the legal entity (in this Free 2 Play Marketing) with which the Participant is entering into the Agreement.

These terms and conditions apply to all Agreements.

Article 2: participation

2.1 The Participant can participate in the event when he/she has filled in the intended reservation form and has filled the form in truthfully, the registration fee has been paid and when the Participant has agreed to the terms and conditions.

2.2 Refund for the registration fee is not possible when the event has already started.

2.3 The Organizer of the Event can decide to stop or cancel the event due to exceptional circumstances (force majeure).

2.4 The Organizer of the Event can change the start time, date or location of the Event.

2.5 When the Organizer of the Event has decided to stop or cancel the event. or change the date and/or location, no liability arises for reimbursement of the costs incurred by the Participant in relation to the Event.

Article 3: liability

3.1 Participation of the Event is done at your own risk. The Organizer is not liable for any damage that the Participant might encounter as a result of participating in the Event.

The Organizer also is not liable for loss, theft or damage to/from property/affairs. Unless the damage is the direct result of intent or gross negligence attributable to the Organizer. This exclusion of liability also applies to serious types of damage such as all possible types of damage in connection with injury, illness or death as a result of participation in the Event.

3.2 If, despite the provisions of the first paragraph of this article, liability must be assumed on the part of the Organizer for damage suffered by the Participant, the Organizer's obligation to compensate for that damage will be limited to a maximum of the amount that the Organizer's insurer in respect of that pays damages.

3.3 The Participant must be adequately insured against the risk of damage that he/she or a surviving relative may suffer as a result of his/her death, injury or illness, caused by his/her participation in the Event.

3.4 The Participant declares that he is aware that participation in the Event requires good health in both a psychological and physical sense, and declares that he/she meets this requirement and that he/she has sufficiently prepared for the Event through training and otherwise.

3.5 The Participant indemnifies the Organizer against liability for damage that third parties may suffer as a result of an act or omission attributable to a Participant with regard to (participation in) the Event. The Participant must be adequately insured against the risk of liability for the damage referred to.

3.6 The Participant indemnifies the Organizer against liability for damage that a third party may suffer through the Participant's actions during his participation in the Event, unless this damage is the direct result of intent or gross negligence attributable to the Organizer.

Article 4: portrait right

4.1 The Participant grants permission in advance to the Organizer for the publication and reproduction of photos and visual material and the like taken during or around the Event, on which the Participant is visible. This also includes the (re)use of images in (advertising) expressions by or on behalf of third parties. The use referred to in this article is free of charge.

article 5: personal data

5.1 The personal data provided by a Participant will be included in a file by the Organizer. By participating in an Event, a Participant grants permission to the Organizer to process and use the personal data to send information to the Participant and to provide the personal data to third parties for the purpose of sending information to the Participant. By entering into the Agreement, the Participant grants the Organizer permission to publish and reproduce his name and competition results, for example by means of publication in newspapers and via the Internet.

Companies participation

article 1: definition 

1.1. In these general terms and conditions, the following definitions apply:

  1. Event: the event that is organized by Free 2 Play Marketing.
  2. Participating Company: a company or institution that has registered one or more Participants in a manner permitted by the Organizer to participate in the Event.
  3. Participant: a person who has been registered by a Participating Company for participation in an Event in a manner permitted by the Organizer.
  4. Agreement: the agreement between a Participating Company and the Organizer, for the participation of Participants in the Event.
  5. Organizer: the legal entity (in this Free 2 Play Marketing) with which a Participating Company has entered into an Agreement.

1.2. These terms and conditions apply to every Agreement.

Article 2: companies participation

2.1. Participating Companies can be:
a. Legal entities that have been continuously registered for more than six months immediately prior to the competition day in the trade register of a Chamber of Commerce and Industry;
b. Companies, not being legal entities, that have been continuously registered for more than six months immediately prior to the competition day in the trade register of a Chamber of Commerce and Industry;
c. Legal entities under public law as referred to in Article 35 of the Spanish Civil Code.

2.2. The Organizer may decide in individual cases to refuse to admit companies or institutions that do not meet the aforementioned requirements and other serious requirements (including payment arrears).

Article 3: participants 

3.1 The Participant can participate in the event when he/she has filled in the intended reservation form and has filled the form in truthfully, the registration fee has been paid and when the Participant has agreed to the terms and conditions.

3.5 When the Organizer of the Event has decided to stop or cancel the event. or change the date and/or location, no liability arises for reimbursement of the costs incurred by the Participant in relation to the Event.

article 4: liability

4.1. Participation in the Event is at your own risk. The Organizer is not liable for any damage, by whatever name, that the Participant of the Participating Company and/or the Participating Company may suffer as a result of the participation. The Organizer is also not liable for loss, theft of or damage to property/objects of the Participant and/or the Participating Company. Unless this damage is the direct result of intent or gross negligence attributable to the Organizer. This exclusion of liability also applies to serious types of damage such as all possible types of damage in connection with injury, illness or death.

4.2. If, despite the provisions of the first paragraph of this article, liability of the Organizer for damage suffered by the Participant of the Participating Company and/or the Participating Company must be assumed, the Organizer's obligation to compensate for such damage is limited to a maximum of amount that the insurer of the Organizer pays in respect of that damage.

4.3. The Participant and the Participating Company must be adequately insured against the risk of damage that he/she or a surviving relative may suffer as a result of his/her death, injury or illness, caused by his/her participation in the Event.

4.4. The Participating Company declares by registration that each Participant has acknowledged that participation in the Event requires good health in both a psychological and physical sense, and has declared that he/she complies with this requirement and that he/she has sufficiently prepared for the Event through training and otherwise.

4.5 The Participating Company indemnifies the Organizer against liability for damage that third parties may suffer as a result of an act or omission attributable to a Participant and/or Participating Company with regard to (participation in) the Event. The Participating Company of the Participant must be adequately insured against the risk of liability for such damage.

4.6 The Participating Company indemnifies the Organizer against liability for damage that a third party may suffer at the expense of the Participant during his/her participation in the Event, unless this damage is the direct result of intent or gross negligence attributable to the Organizer.

article 5: portrait right

5.1 The Participant grants permission in advance to the Organizer for the publication and reproduction of photos and visual material and the like taken during or around the Event, on which the Participant is visible. article 7: facturation

7.1 Payment must be made to Moneybird B.V. within the set payment term. (hereinafter: “Moneybird”). All rights under the claim are transferred by the Organization to Moneybird, who will collect the claim. Your data will be tested and registered by or on behalf of Moneybird. This data can be used, among other things, for the collection of claims and testing of orders in the implementation of the acceptance policy of affiliated organizations.
7.2 Inorder to keep your place, 66% of the payment must be received within 10 days of registration. The final payment is due 7 days prior to the event date.
7.3 Cancellation received 30 days or more prior to the event date , is due a full refund of the fee paid.
7.4 Cancellation received 29-15 days prior to the event, 50€% is due a full refund of the fee paid.
7.5 All payment fees must be covered by the participant and may not be deducted from the amount remitted.

article 8: applicable law and choice of forum 

8.1 These general terms and conditions as well as participation in the Event and all rights and obligations arising therefrom are exclusively governed by Spanish law.

8.2 All disputes arising from these general terms and conditions, the agreements arising therefrom and participation in the Event, will in the first instance be exclusively settled by the competent court in Mallorca.
